Easements and Rights of Way: Florida Law and Surveying Practice is a six-hour live webinar developed for professional surveyors and mappers. The course examines the legal nature of easements and rights-of-way and explains their importance in boundary surveying and the preparation of survey maps and reports. Participants will review common classifications of easements, including affirmative and negative, exclusive and nonexclusive, appurtenant and in-gross, and public and private easements.

The course discusses the creation of easements by written conveyance, implication, necessity, prescription, estoppel, reservation, dedication, eminent domain, and operation of law. It also examines methods by which easements may be terminated and considers questions involving the scope, expansion, misuse, relocation, abandonment, and overburdening of easement rights.

Special emphasis is placed on Florida law and surveying practice. The webinar reviews applicable provisions of the Florida Statutes, Florida’s Standards of Practice for surveyors and mappers, and selected Florida court decisions involving road rights-of-way, common-law and statutory dedication, presumed dedication through governmental maintenance, ownership of land within road rights-of-way, centerline presumptions, vacation and abandonment, and reversionary interests. The course is intended to help surveyors recognize, research, locate, evaluate, and accurately report easement and right-of-way evidence encountered during professional surveying services.

Attendance Requirements

Continuing Education Credit

Participants who successfully complete the webinar will receive a Certificate of Completion. Florida Surveyors and Mappers will have credits electronically reported to the Florida Board. One continuing education hour is awarded for each 50 minutes of instruction.
